Risk during Pregnancy and Breastfeeding

If your job includes tasks or conditions that may pose a risk to you, the fetus, or your child under 9 months old, we put in place a process to ensure your safety and your rights.

  • We assess the conditions of your position to determine if there is a risk during pregnancy or breastfeeding.
  • We issue the risk certificate, when appropriate, after medical and technical analysis.
  • We manage and pay the financial benefit if a change of position is not possible and your contract has been suspended. The benefit covers 100% of your regulatory base from the first day of suspension.

To manage risk during pregnancy/breastfeeding, you will need to complete two phases: First, obtain the medical certificate of risk and then apply for the financial benefit, if applicable.

PHASE 1. Obtaining the medical risk certificate (Prerequisite for any suspension and benefit)

If you are medically cleared, you can request a medical certificate of risk during pregnancy/breastfeeding from FREMAP by submitting the following documentation:

  • Completed and signed medical certificate application.
  • Proof of identity (as indicated on the form).
  • Medical report from the Public Health Service that certifies the pregnancy, indicating weeks of gestation and probable date of delivery or natural breastfeeding.
  • Copy of the contribution receipt from the month prior to the application.
  • If you work in a cooperative, worker or commercial society or are economically dependent (TRADE): Company certificate regarding the activity.

With this documentation, FREMAP will assess your situation and issue the medical certificate confirming the existence of the risk, if applicable.

PHASE 2. Application for financial assistance Only if it is not possible to adapt or relocate the worker to a compatible position.

Once FREMAP has issued the medical certificate of risk, and if there is no safe alternative position, you can apply for financial assistance for risk during pregnancy/breastfeeding with this documentation:

Once FREMAP has reviewed all the documentation and verified the existence of risk and the impossibility of adapting the position, we will issue an agreement recognizing the benefit, which will remain in effect until one of the following situations occurs, which you must inform us about: 

Risk during pregnancy: Risk during breastfeeding:
The start of maternity leave. The interruption of breastfeeding. 
The resumption of professional activity. The child turns nine months old.
Deregistration from the Special Regime for Self-Employed Workers of the Social Security. The resumption of professional activity.
The termination of pregnancy.  Deregistration from the Special Regime for Self-Employed Workers of the Social Security.
